By accessing or using the ICE Activity Tracker platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

Changes to Terms: We reserve the right to modify these Terms at any time. Continued use after changes = acceptance. Review periodically.

What is This Service?

The ICE Activity Tracker is a community-driven platform that:

• Aggregates reports of U.S. Immigration and Customs Enforcement (ICE) activity
• Displays reported locations on an interactive map
• Scrapes public social media posts (Reddit) for ICE-related content
• Allows community members to submit location reports

This is NOT:

• ❌ Official government information
• ❌ Legal advice
• ❌ A substitute for immigration legal services
• ❌ Verified or fact-checked information
• ❌ Real-time tracking of ICE operations

Who Can Use This Service?

Age Requirement

You must be at least 13 years old.

Legal Capacity

You must have the legal capacity to enter into binding contracts.

Prohibited Users

You may not use this Service if:

• You are under 13 years old
• You are a convicted felon whose crime involved deception or fraud
• You have been previously banned from this Service
• You are using the Service to harass, stalk, or threaten individuals
• Your use would violate any applicable law

What You Can and Cannot Do

Acceptable Use

• ✅ Submit truthful reports of ICE activity you witnessed or learned about
• ✅ Share the platform with others in your community
• ✅ Use the map for personal safety and awareness

Prohibited Activities

• ❌ Submit false, misleading, or fabricated reports
• ❌ Submit reports to harass, dox, or target specific individuals
• ❌ Impersonate others or misrepresent your identity
• ❌ Violate anyone's privacy (no home addresses of ICE agents)
• ❌ Use the Service to threaten, incite violence, or coordinate illegal activity
• ❌ Attempt to circumvent rate limits or security measures
• ❌ Scrape, crawl, or extract data using automated tools (use our API instead)
• ❌ Upload malware, viruses, or malicious code
• ❌ Interfere with the operation of the Service
• ❌ Use the Service for commercial purposes without permission

Content Moderation

We reserve the right to remove any content that violates these Terms, without notice or liability.

Your Content and Reports

Ownership

You retain ownership of the content you submit (location reports, descriptions). However, by submitting, you grant us a non-exclusive, worldwide, royalty-free license to:

• Display your report on the public map
• Store your report in our database
• Aggregate your report in statistics
• Share your report with researchers (anonymized, if applicable)

Responsibility

You are solely responsible for the content you submit. You represent and warrant that:

• Your reports are truthful and accurate to the best of your knowledge
• You have the right to submit the content
• Your content does not violate any third-party rights
• Your content complies with all applicable laws

No Confidential Information

Do not submit confidential or proprietary information. Treat all reports as public.

Disclaimers

We disclaim all warranties, express or implied, including:

• ❌ Accuracy or reliability of reports
• ❌ Merchantability or fitness for a particular purpose
• ❌ Non-infringement of third-party rights
• ❌ Uninterrupted or error-free operation
• ❌ Security or freedom from viruses

Specifically:

• Reports are user-generated and may be inaccurate, outdated, or false
• We do not verify, fact-check, or endorse any reports
• Geolocation data may be imprecise (±50-500 meters typical error)
• The Service may be unavailable due to maintenance, outages, or attacks
• We do not guarantee the Service will meet your needs

Limitation of Liability

• Direct, indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Personal injury or property damage
• Harm resulting from your use of the Service
• Harm resulting from user-generated content
• Harm resulting from third-party actions based on reports

Even if we have been advised of the possibility of such damages.

Cap: Our total liability to you for all claims related to the Service shall not exceed $100 (or the amount you paid us, which is $0).

Exceptions: Some jurisdictions do not allow limitation of liability for personal injury or certain damages. If your jurisdiction prohibits this, the above may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless:

• The ICE Activity Tracker platform
• Its operators, developers, and contributors
• Hosting providers (Render.com, Neon.tech)

From any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any law or third-party rights
• Content you submit to the Service
• Your negligence or willful misconduct

Copyright and Intellectual Property

Our Content

The Service design, code, and original content are protected by copyright, trademark, and other laws. You may not copy, modify, or distribute our content without permission.

User Content

You retain rights to your content, but you grant us the license described in the "Your Content and Reports" section above.

DMCA Compliance (Digital Millennium Copyright Act)

If you believe content on our Service infringes your copyright, send a DMCA notice to:

Termination

By Us

We may terminate or suspend your access to the Service immediately, without notice, for:

• Violation of these Terms
• Submission of false or abusive reports
• Harassment of other users
• Attempted hacking or security breaches
• Any reason or no reason (we reserve the right)

By You

You may stop using the Service at any time.

Effect

Upon termination, your right to use the Service ceases. Sections that by their nature should survive (disclaimers, liability, indemnification) will survive termination.

Governing Law

Jurisdiction

These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict of law principles.

Venue

Any disputes shall be resolved exclusively in the state or federal courts located in Cook County, Illinois.

Arbitration

Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. You waive your right to a jury trial and class action.

Exceptions

Either party may seek injunctive relief in court for violations of intellectual property rights or confidentiality obligations.

Miscellaneous

Entire Agreement

These Terms constitute the entire agreement between you and us regarding the Service.

Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

Waiver

Failure to enforce any provision does not waive our right to enforce it later.

No Agency

Nothing in these Terms creates a partnership, employment, or agency relationship.

Force Majeure

We are not liable for delays or failures due to circumstances beyond our control (natural disasters, war, government actions, internet outages).

Community Guidelines

These guidelines help keep the ICE Activity Tracker safe and useful for everyone.

Good Reports Include

• ✅ Specific location (address, intersection, neighborhood)
• ✅ Time and date of observation
• ✅ Brief description of what you saw or heard
• ✅ Source (if from social media or news)

Avoid

• ❌ Vague locations ("somewhere in Chicago")
• ❌ Speculation or rumors without basis
• ❌ Personal information about individuals (names, photos, home addresses)
• ❌ Inflammatory language or calls to violence

Safety and Privacy

Protect Yourself:

• Do not include your own personal information in reports
• Do not submit reports that could identify you
• Use a VPN if you're concerned about privacy
• Assume all reports are public and permanent

Protect Others:

• Do not post names, photos, or addresses of individuals (ICE agents or otherwise)
• Do not post information that could be used to harass or target people
• Focus on locations and activities, not individuals

What Happens to Reports

1. Automatic Geocoding: Your location text is sent to OpenAI to extract coordinates
2. Public Display: Approved reports appear on the map within seconds
3. Retention: Reports are deleted after 7 days (rolling window)
4. Moderation: We may remove reports that violate these guidelines
